Explains the rules of advertising and promotion through various media, what is permitted and what is prohibited according to the regulations in force in Indonesia.
Market Indonesia realizes that advertising and promotions can be viable methods for Independent UnFranchise® Owners to build their businesses. However, there needs to be strict regulations in place to maintain effective and ethical marketing efforts. These regulations are part of the Independent UnFranchise Owner Application and Agreement (IUA&A) between Market Indonesia and its UnFranchise Owners.
Non-compliance with the advertising regulations by some UnFranchise Owners may have adverse consequences for all Independent UnFranchise Owners. An UnFranchise Owner’s failure to comply with the policies, procedures, rules and regulations set forth in this section may result in the termination of UnFranchise Owner status and the loss of future income with the company. An UnFranchise Owner who is found to have intentionally violated these provisions, which affects our goodwill and reputation with government authorities, state bodies or local authorities, may have their UnFranchise Owner contract terminated and/or reported to the appropriate authorities. Additionally, Market Indonesia may take legal action against those violating Market Indonesia’s advertising policies, procedures, rules and regulations.
Any notice created to attract public attention or patronage, including but not limited to training materials, flyers, display advertisements, newsletters, emails, website advertisements and even personal letters, may be considered a means of advertising.
Approved literature:Only official Market Indonesia literature offered by the company may be used to represent Market Indonesia’s home business and Market Indonesia’s Management Performance Compensation Plan (MPCP). Company literature may not be duplicated, copied or reprinted without the company's written consent.
Approved advertising/materials: Only company-approved materials, as provided by the UnFranchise Management System or as permitted by the company, may be used in advertising placement in any print media. UnFranchise Owners can only use income or product claims published and approved by Market Indonesia. Use of unauthorized income or product claims is grounds for the company's initiation of the Corrective Action Procedures. Unauthorized income and product claims are not permitted even if the Market Indonesia name or product name is not used in the advertisement or claim. Note: In Canada, UnFranchise Owners making revenue representations must provide average Canadian UnFranchise Owner earnings (average earnings prepared by Market Indonesia annually).
Use of proprietary materials/intellectual property: No person or entity may use Market Indonesia’s name, logo, trademark, trade name or copyrighted material (hereinafter referred to as “intellectual property”) in any advertisement that is not produced by Market Indonesia or its authorized agents without written permission from Market Indonesia.
Permitted use of company name: Use of the company name on any goods not manufactured by the company is prohibited except in the following manner:

UnFranchise Owners are prohibited from using radio, television, and Internet advertising and public appearances to publicize Market Indonesia, its compensation programs or home business opportunities without prior written approval from the company.
UnFranchise Owners who advertise and promote their business via social media on social networking or similar sites must also comply with the Social Networking Sites Policy in Chapter 20: Internet and WebCenter Policy, Sec. 12: Social Networking Sites.
UnFranchise Owners may not produce for sale any recordings of company or GMTSS events or speeches without written permission from Market Indonesia, nor may they reproduce for sale or personal use any recordings of company-produced presentations in any format.
UnFranchise Owners may not answer the telephone by saying, “Market Indonesia,” or in any other manner that would lead the caller to believe they have contacted the corporate office.
Answering service: If the UnFranchise Owner has an answering service or telephone answering machine that mentions Market Indonesia, the message must indicate their Independent UnFranchise Owner status.
Listings: UnFranchise Owners may be listed in a telephone directory only in the following ways:

Telemarketing: UnFranchise Owners may not use outgoing recorded messages to promote Market Indonesia products or entice new UnFranchise Owners. Such activities are regulated or restricted by the laws or regulations of many countries or jurisdictions and are expressly prohibited.
Telephone approach: If an UnFranchise Owner engages in telephone solicitation, they must introduce themselves as an Independent UnFranchise Owner of Market Indonesia and not engage in any representation inconsistent with the status and relationship between the Independent UnFranchise Owner and Market Indonesia. UnFranchise Owners must also familiarize themselves with and comply with applicable laws and regulations that prohibit or restrict the conduct of unsolicited telephone calls, including the “prohibited call list” of a statute.
Any printed materials, including business cards and stationery, must be of good quality, professionally created and a proper representation of the independent status of the UnFranchise Owner. Using the Market Indonesia logo on personal business letterheads, bulletins, advertisements, electronic cards or communications is prohibited without stating their Independent UnFranchise Owner status.
Market Indonesia has no affiliation with any direct sales, network marketing or multilevel marketing companies. DO NOT send solicitations for any other products, services or marketing plans in the same envelope or package as Market Indonesia literature.
A Market Indonesia UnFranchise Owner can discuss and provide products as long as it is done in good faith and quality. Promoting another company’s products or services in the same “booth” is strictly prohibited, and violation of this may be grounds for termination.
If UnFranchise Owners have ideas for advertising, literature or promotions, they must submit a written request for approval, including the following information:
Samples of proposed items must be provided for review in their final form and look exactly as the UnFranchise Owner (UFO) intends when published.
Detailed information regarding the item's intended use must also be provided; for example, if a UFO wishes to place an advertisement in a local newspaper, the request must include the newspaper's name and the date the advertisement will appear.
Any additional relevant background information.
Requests will be reviewed in the order they are received. UnFranchise Owners must allow 7–10 business days for the review process.
Executive Coordinators sign an Executive Coordinator Agreement promising to carry out the terms and conditions of the agreement as part of their right to receive continued compensation (commission) in the MPCP.
Responsibility: Executive Coordinators are required to monitor and enforce these policies by reporting violations to the company. Failure to enforce this policy within their organization may result in compensation being withheld until the issue is resolved.
Violation: UnFranchise Owners who copy or use copies of company literature or produce their own literature or advertisements without obtaining written approval from Market Indonesia may be subject to sanctions, including but not limited to written warnings, demands that the unapproved material be destroyed, Group Business Volume flushed (erased to “0”) and termination, at the company’s sole discretion.
Only generic materials approved for use by Market Indonesia may be used in conjunction with Market Indonesia activities. A list of approved generic materials can be obtained from the GMTSS Director.
Sale of generic materials:UnFranchise Owners may not sell generic sales aids as part of their Market Indonesia business. However, they can refer individuals interested in purchasing items not offered by the company to appropriate places to purchase those items (for example, referring an UnFranchise Owner to a bookstore to purchase a book that has helped you become successful). Items on the Approved Generic Sales Aids list may not be sold directly by the UnFranchise Owner, even if no profit is involved.
Getting generic material: UnFranchise Owners may only purchase for use in their Market Indonesia business generic sales aids or business-building materials on the Approved Generic Sales Aids list.
Getting approval for new materials: If UnFranchise Owners identify general materials that they feel would be helpful to other UnFranchise Owners, they may submit the items and written proposals to their upline Advisory Council Member for review.
If the Advisory Council Member assesses that the item has advantages and value, then the Advisory Council Member must submit the item to the Market Indonesia Advisory Board for review and consideration.
If the Advisory Board approves, the generic item will be added to the Approved Generic Sales Aids list.
